Michigan special assessments: what your board must do.

Condos only: a recorded lien notice must be mailed to you 10 days before foreclosure.

Does the board need an owner vote?

Michigan's Condominium Act sets no owner vote for a special assessment; your master deed and bylaws decide. Associations must maintain a reserve fund for major repairs and replacement of common elements.

What notice must owners get?

Owners are usually entitled to written notice that states the amount, the purpose and the due dates. Many states also require the board meeting where it was approved to be open to owners and noticed in advance.

Your right to see the records

The books, records, contracts and financial statements about running the condominium must be available for you to examine at convenient times. An association with annual revenues over $20,000 must have its books independently audited or reviewed each year, unless a majority of members vote to opt out. This law sets no deadline for the association to respond.

MCL 559.157

Payment plans, late fees and liens

Unpaid assessments, interest, collection and late charges, attorney fees and fines under your condominium documents are a lien on your unit. Foreclosure cannot start until a notice of lien is recorded and mailed to you by first-class mail at least 10 days before the proceeding begins. The redemption period is 6 months from the sale, or 1 month if the property is abandoned.
